My son cosigned for a loan. Now that person is not going to pay, and it's been sent to collections. I know he is responsible for the loan, but if he ends up paying for this loan, can he take that person to court and sue for reimbursement?:confused:

hi, karenb. you can take it to court. but first how much is the amount? from what state are you? you can actually bring the matter to the small claims court if the amount involved does not exceed the limit set on your state. lawsuits in small claims court are limited to between $3,000 and $10,000 depending on the state.

The amount of the Sallie Mae loan is now up to around $1800.00. We live in the state of Ohio. Can we go to Small Claims court without an attorney?
