In September I was riding with the son of a friend. We were pulled over by the Sheriff. When we were pulling over the young man opened the ashtray and pulled a 1/2 ounce of marijuana and said do something with this. I was shocked told him why did he have that in the car. Well they searched the car and found it. The young man told them that it was his and we were handcuffed standing beside the road. These men knew the young man. He went behind the car and talked with the men. The next thing I know they are taking the handcuffs off and letting us go. One sheriff came up to me and said "Do not play me for stupid that he knows what is going on." That was on a Thursday. I asked the young man why did they let us go since he had what he di. He told me that they said they were no looking for marijuana. I thought that was crazy.

The following Wednesday the sheriff came to my house and arrested me. I was told it was due to the fact that the young man did not keep us his end of the bargain. I had no ieda what bargain he was talking about. I went to jail overnight. I was charged with possession of marijuana with a bond of $1500.00. I have never been in troulble with the law and have never had any drug charges. I understand they do have the young man that was with me just they had to arrest someone and since I was home it was me.

This is a nightmare and I would like to know if this really the legal way to do this. Since the young man already had a possession charge for marijuana in a different county and had seveal drug charges in the past, he should of been the one arrested.

I would like to know what my rights are I am not guilty of this charge. Thank you in advance for any help you can give me.

I'm not an expert, but I don't think you should have been arrested if it wasn't yours. The only thing I can think of is if the guy who owned the marijuana lied and said it was yours. Or I know sometimes that they can charge you if you are in a car with someone and drugs are found, but I don't know why they can charge you. I just know that sometimes happens. It's just a bit confusing as to why they didn't arrest HIM, too. I would just try to hire an attorny and ask and see what's going on. Good luck.
