Me and my wife of 13 years separated in March of this year after a couple years of unhappiness on my part. She travels out of town 3-4 days a week and I raised our 3 sons while she was gone. One was still in diapers when she took this new job. I was very unhappy about her travel and told her we needed counciling a year before the split; she refused to go back after 4 visits. During our separation (even though we lived in the same house) she traveled a lot less (1-2 days a week). In October of this year she filed for Separation Agreement and moved out of the house. I told her I wouldn't fight her for custody as long as I could see my kids whenever I wanted; she agreed. Since signing our agreement, she has resumed her traveling schedule. I have see my kids 5-6 days a week, and they stay at my house at least half the time due to her travel. I wanted to give her a chance to have the kids if her travel was reduced (like during our separation) but it appears she has reverted back to heavy travel. I pay her child support even though she make twice as much as I do. Even though I have an attourney and was gonna file in June, I got a mediator and tried to make things work. I'm wondering if a judge will agree to give me primary convservatorship and revoke it from her. I am not seeking child support from her, only that she pays for them when they are with her and I'll take care of them when they're with me; we can work out any other expenses jointly. Would that be considered reasonable by a judge or does her travel not really justify a change in conservatorship?
