I was granted full power of attorney to my aunts estate. She has a trust in which has recently grown from the sale of her home. The trust pays the nursing home until all the funds are depleted. We expect the funds to be depleted in about 2/3 years. At this point she can stay in the home and use social security and government aid to cover her expenses.
Question: I have a joint checking account with my aunt in which she receives her social security checks monthly. This account is not part of the trust and I use it to pay for her personal items/services that she enjoys. I also use it to purchase gifts for her family members as well as myself. This is all done with her verbal approval. I am a little hesitant to be using this account in such a manor but I assume that since she has given approval it is a non-issue.
As I said before the power of attorney has no limits set on it but I am worried that the nursing home can come after me when her trust runs out of funds.
I am also not clear on what is fair as far as taking funds out of the checking account for my services as power of attorney.
