View Full Version : Not read my Miranda Rights or Fingerprinted

I was taken into custody Friday night. I blew .15 on the state breathalyzer machine. I was held the mandatory 8 hours, then released on $2500 bond. I was never read my Miranda Rights or Fingerprinted. My mugshot and profile were taken. Now I have to go to court over these charges. Can this be thrown out of court? Thank you for any help I can get. I live in Indiana.

The whole "you did not read me my rights" facade is merely TV shinanegans. It is impossible to prove that an officer did not read you your rights. As for the fingerprinting not beig done that is internal on that departments shoulders and will hold absolutely no wieght in court for your case. You were found to be legally intoxicated therefor your accounts of the evenings events are further in debate as the breathalyzer report shows that you were over the legal limit. Sorry to be the bearer of bad news. Just pointing out the facts.

Even if (and there is no if) Miranda was violated they only thing it would do is exclude any statements you made from being use din court. Your BAC your FST the Officers observations all would still be allowed in trial which will be more than enough for a conviction
