View Full Version : Help! mva lawsuit advice

I was involved in a mva last year. There was minimal damage to either vehicle, no one received a citation however i was found to be at fault because i rear ended the other party's vehicle. My ins company sent them a settlement, they refused and returned it saying it was not enough, keep in mind this was only a small ding in the rear bumper. The ins company wanted to give them 487.00, they have an estimate from an auto shop of their own for 2068.00, however i received a summons that they are going to sue me for 5000.00 for damages to the vehicle and the fact that they traded the car and attorney fees for civil court. Here is the kicker, the other party is an attorney who tries auto claims, he blatantly lied in his deposition saying that his car was extremely damaged to the point that he could not drive it. He drove away from the accident, not even a scratch on the car. Since this shark is an attorney, how do i protect myself, i cannot afford to pay him 5 cents let online 5k and how come he is not suing my insurance company?
