My exboyfriend signed a Minnesota Voluntary Recognition of Parentage when my son was born. He and I have lived together since his birth, almost 4 years ago. We recently broke up and my boyfriend moved out. We purchased a home together and he is planning on filing bankruptcy or selling it. I cannot afford to keep it on my own. With him filing bankruptcy and the mortgage not being paid, my credit is ruined. This will prevent me from being approved for an apartment or rental. I have one option, my mother and father (who live about 2 hours away) offered to take me and my children in. I can live with them in their home. My exboyfriend states that he will not allow me to move. Keep in mind, that right now he has NO legal rights to our son. He signed a form that says he acknowledges he is the father, but that he also realized by signing the paper that he had no legal rights to him... If he wanted custody or visitation he had to file that request with the court... He hasn't yet. I am willing to let him see our son every other weekend and want work out a visitation schedule so that he can see him as much as he can. I have even offered to meet him half way to exchange him for the visits. I am not trying to take our son from him. I just need a place to live. He is being difficult and is very persistant on the fact that he will not allow me to go. My ex has applied for several job openings that are half an hour from where my children and I would be living with my parents. He is trying to move near my parents anyways. I guess my main question is, if I pack up and leave, have I broken any law? Can he prevent me from going? If I go, can he or the court system make me move back, even though I literally have no other option as far as a place to live is concerned?
