My husband and I have been married a year, Prior to our marriage he had a live in girfriend he aquired land and a home the last year of them being together. She was a cosigner for the loan on this, so everything that comes to the house is in both names concerning the mortgage the land title has both their names on it but the home has only his name but the loan is rolled all into one she has never made a payment on it and only lived in the dwelling off and on for 11months then abandoned him, their daughter and the property {to go stay on crack}this was a year and a half ago. My question is if he died tomorrow is she able to come take my home that I have been helping make payments on even though we are married and he has a will saying everything that was in his name upon his death goes to me? and if so, how can I fix this to where she has no legal rights?

I am not an expert but if I were you I would try and have her name taken off the land ownership documents. Unfortunately, even though she has never made payments, the loan company will not be able to determine exactly where the repayments are coming from. In their minds, she may have given him half the money and then he was paying it back himself.

I would like to live in the comfort of knowing that my home and land was safe from others being able to strip it away so I personally would have a legal secretary have a look at the situation.

Is your husband concerned too??
