We are not friends, or related nor is she my ex- anyting. I never knew her before now.
HELP !!!!
I am a sub-contractor in the flooring industry having installed flooring for over thirty years. My tools are my livelihood. To shorten a long story: I partnered up more or less with another installer that had a van but very few tools. I had the tools. I was not aware of anything going on in his personal life especially concerning the van. He was unable to have the van put in his name for what ever reason so it was put into his then girlfriends’ name. They later parted on a bad note and she refused to sign the title over to him. Therefore he was unable to get the appropriate paperwork to keep the van legal. I found all this out after the fact. He was driving the van early one morning and had a wreck which put him in the hospital and totaled the van. The van with all my tools was towed to a wrecking yard. I contacted the wrecking yard and inquired as to what I needed to do in order to retrieve my tools. He told me that he would need a signed and notarized affidavit from the registered owner releasing them to me. I went to the person that I thought owned the van and this is when I found out the rest of the story. I was given his then ex-girlfriends’ name and went to her asking her if she would release my tools to me, I would even pay for the notary. She became irate and refused, told me that she was going to keep the tools as payment for money owed her by her ex-boyfriend. These are my tools, not his. Can she keep my personal property to pay someone else’s debt? What can I do? I have to have my tools they are my livelihood.
