Officer Lied or messed up report..need advice

Morning all ,

Well I'll make it short and if you have any Q's I'll be happy to answer them. In the police report on me the officer said he turned on his dash camera and observed me swirving in and out of traffic. I'm going through court now and come to find out thier is NO tape. He never used his Dash Cam. I breath test came up .0 so no alcohol but I was using Prescribed medications which came up in the Tox report. All legal and in my name. So , can his report be tossed out of court for lying about the Dash Cam?

If they are not able to produce the evidence they have, they can't use it in court or even mention it in the trial. chances are the case will be thrown out of the system.
