View Full Version : Lessees incarcerated, landlord wants money

I don't know what I can do to help my friend. She and her roommate, both named on the lease agreement, have been arrested and are currently in jail awaiting hearing. A friend of theirs was taking care of the apartment and paying rent, etc, until recently. I don't know exactly what happened to the "friend" but now, the rent is due, there is a late payment fee due and the utilities that the landlord paid for is due. The locks were changed and the landlord wants the keys. I picked up the mail for my friend as per her request and there was a letter from an attorney representing the landlord. It states that "I write to give you notice that only the named lessees are authorized to pay rent and that (the landlord) will no longer accept rent that is paid or offered by any person other than a named lessee. " Then it states that the utilities and late payment is due. Also "any person who is not a lessee cannot stay at the property for more than 14 days " unless they pay $65.00 a day. The keys are also requested for the changed locks.
My friend asked me to help her with this matter and I am trying. I cannot get into the apartment because I do not have keys either and cannot find the girl who had them (the friend), I don't want her to lose her stuff or her apartment but I don't know what to do or how to go about it.
Please help, I need advice and I am extremely limited in funds otherwise I would have contacted an attorney specializing in these matters here.
