My mom died in April 2004 she had a will which stated that her residuary estate be sold and dived amongst myself and my 4 siblings. My sister is the exeuctioner of the will and she hasn't done anything about it yet. She's also renting out mom's house. Is there anything I can do to get mom's will and wishes started? I heard that I waited to long and I can't due anything even though my name is on one of her properties. Her whole estate is worth about$350,000.00. HELP!!:):confused: Thanks.:)

That sounds almost exactly what my husband and his two siblings are going through. I do know from the time that the person is made an executor/personal representative, that the heirs have 2 or 3 months to contest it. After then, I don't think that there is anything that you can do. Personally, you should have been on top of things. You should have petitioned to have the estate supervised by the court. If you were the only sibling that feels this way then you won't have a case. 4 years is way too long to wait to do something about it. But if you want to try, go for it. Talk to an estate attorney about it and see what they say in your state.
