View Full Version : Parent's rights to children's gifts???

Hello. I am in Florida (13th Circuit) and was wondering if there is any way for my stepsons to retain possession of gifts given to them that are at their mother's residence. She filed for Primary Residential Custody and was denied in July 07. Since then she has refused to speak with her children(including birthdays and holidays), refused to exercise visitation, and refused to allow them to retrieve some of their personal possessions from her house. Most of these possessions have no monetary value, such as the personalized ceramic plate commemorating the birth of the youngest, made for him by his grandfather. Can their father file suit for these items in small claims court (or family court), or is this avenue denied due to the children being minors (12 and 15) and/or their mother still having shared custody?
