I was arrested two days ago while in my car. I was surrounded by cops and told to get out of the car they asked for my license. they said I had a warrant, however they did not show me a warrant. They put me in the car and never told me what I was being arrested for. They got in my car and drove it to my house and parked it. They took me out of the car and a detective asked me if I would mind them searching my house I said no. They took me in my house and they searched. They found nothing but they arrested me on drug charges. Possession of Marijuana and intent for I believe x-pills.
This comes as a result of an incident that occurred in Dec 2007. While at home with my ex-boyfriend. His cousin was outside in my driveway playing his music too loud. The police came. He was smoking marijuana and he had 3 x-pills in his pocket. He lied and told the police he lived there. Therefore they wanted to search my house. I signed at that time for them to search because I thought I knew that nothing was in my house. My ex also had another friend who was there. The cops found marijuana hidden in my sofa. I believe they said it was 1/2 pound. They ran the my ex friend and found he had a traffic warrant. They took him to jail and charged him with all of the charges for drugs, the loud music, and the x-pills. They then took me, my ex, and his cousin downtown to the detective's office. They made a deal with my ex to provide info to them on some people. So basically they wanted him to rat some people out to avoid going to jail. They let us walk out of their office scot free. I had no knowledge that my ex's cousin hid the marijuana in my sofa and my ex did not know either. The cousin told this to the police and owned up to it.
Two days ago when I was arrested they told me that my ex did not follow through and I was going to jail, but if I could have contacted him immediately and got him to come to my house that I would not go to jail. Now, because he is my ex I had no way of contacting him and I believe they thought I was lying so they took me to jail still with no warrant. Even when I got to the jail they had no warrant but I was still booked. I bonded out that night though. I just want to know is the law on my side here? I read that if I did not have knowledge then I can't be charged with possession? I am a college grad, currently working on my MBA. I have no criminal history. I had nothing to do with this, but because it is my home I'm all caught up in it. If anyone has any insight into what I should do to get this thrown out I would appreciate the advice.
