My brother's doctor has been taking him off some of his medications. As a result, my brother had to go the emergency room. The ER doctor gave my brother a letter for his physician saying that in his opinion, it would not be a good idea to discontinue the meds and perhaps substitute some of the meds. Otherwise, the result could be seizures or stroke. When my brother gave the letter to his doctor, the doctor thew it on a chair and said, I'm not prescribing you anything! Less than a week later, my brother had a stroke. Does he have grounds for a medical malpractice/negligence suit Thanks for any help offered.

Ever since then, there has been a big difference in the doctor's attitude with him telling my brother You do drugs.

Confer with a lawyer specializing in medical malpractice.
There may be a ground for medical malpractice. To ascertain more, second opinion from a much-qualified doctor is necessary.

I agree with 'Dyrah' that it is best to contact a legal advisor as soon as possible. I had a similar claim with my Grandmother who ended up hospitalised for 3 months. I was able to make a claim and gain some compensation. Unfortunately I am not a legal expert and every case is different but you need to find out exactly what your rights are in your situation. The only person to help you would be a lawyer with expertise in this area.
