My mother bought a 3 acre piece of property in Lake County, IN approx. 12 years ago. About 4 years ago she got into some legal trouble and was going to sell the property for 3 times what she paid for it. Her boyfriend (who lived with his mother up to this point) convinced her to 'sell' the house to him so that she wouldn't lose it and promised to take care of her, never make her move out, etc... The BF had no credit to speak of (being a 45 yr old man?!) so my mother lowered the price to a third of she would have gotten selling it outright. The BF has a sister-in-law who happens to work at a bank so they used this particular bank for financing. It was the banks FIRST year doing mortgages. The situation was explained to the bank president, title company, basically anyone who would listen. The bank claimed that my mom's name could not be put on the deed even though she put all the proceeds from the sell back into the purchase as the down payment. The title co. said since the bank didn't have it on the mortgage, they could not put it on the deed. NOW, 4 yrs later, the BF has decided he doesn't love my mom. He left the house on the day before Easter and has supposedly started the Eviction process. My mom has talked to the bank president who remembers the situation and who readily admits that she should have told my mom not to do it at the time or at least checked to see if a pre-nup or some other documents would ensure that this didn't happen. My mother has had her name on the Home Owners Insurance and all utilities for 12 years. Does she have any options here to save the home or at the least sell it and split the proceeds with the Ex? I also wanted to mention that my mom filed an Order of Protection against the BF and when he found out, he put a hold on the mail at the Post Office (no one notified her) so when the letter came with the court date she never got it. He went to court and since she didn't show the order was denied, that is when he started the eviction proceedings. She went to the PO and asked if the BF could get in trouble for preventing her from receiving her mail and they told her no!?! She has contacted a few Atty's and none of them take these kinds of cases. Any suggestions?
