I loaned a property developer $90k in 2003 He gave me a Promissory Note and a signed personal guarantee to cover the return of the funds. He repaid $45k in 2005 but nothing since. He now owes me the remaining $45k plus penalties and interest (that were agreed in the Note). He has not made good on repaying the final $45k of the principal amount despite repeated requests. He still claims that I will get the money. How do I get him into court and get a judgement against him for this amount? Thanks.
