We have a neighbor who is beginning to clear all the land next to my mother's property to put up a fence. As far as we know some of the trees they tend to take down are on my mother's property. They didn't have the land surveyed. Can they continue to clear the land and put up a fence without the land being surveyed? We are having a surveyer come out to survey my mother's land, but he can't get out there for another week. In the mean time the neighbors are still clearing trees.

In my OPINON, you need to have an attorney have a judge get an injunction to STOP the cutting while this going on. I know this Post may be to late but if he did cut your trees he has to pay for them and the damage they caused to you and your Land Value, not just lumber cost. But the difference in actuall Real Estate Value, the difference it would mean to a buyer, and Real Estate is Emotional, it is worth WAY more with the trees standing.
Most folks have the attitude of asking for forgiveness is better than getting permission, they will continue to run you over unless you make a stand. Also if you build a fence, in my state anyway, the neighbor has to pay half if its on the line - check your state laws. If this is over, trees gone, still go for justice, not vengance, but expose all parties online and seek compensation with as little out money to you as possible.
