I want to back out of the contract to sell my home because I don't have the money to cover my past due taxes, the seller and the realtor are upset and thinking about sueing. What can I do, do I need an attorney, how can I get out of this jam? Can they make me sell even with the taxes being owed on the property? I live in texas. :confused::confused:

In your situation it is best that you contact an attorney in your location to help you figure out what you can do to remedy the situation.
Getting out of the mess is not that easy especially when you have committed something.

The Realtor may be able to Enforce the Commission, however if it was not a full price offer than maybe not, you should consult and attorney yes, but my opinion is that if you just let them "sue you" than present your hardship case, and your reasons why you don't want to sell, prove your tax situation, and other information that you did not have or was not told. Now if the Realtor knew your tax and how bad your situation would be financially and did not advice you on all your closing costs or at least a close approximation, than the Realtor should be liable for this, blog about it in your local area, make noise, no one will stand up for your consumer rights in real estate - you have to make a stand yourself. Did the Realtor, Seller, Title company mislead you on what your tax situation or bottom line was? Let them "Think about suing" i know from experience that most buyers and seller fold their hand when you threaten to sue, they say this to get you to follow through with the sale, when in reality it may cost years, and lots of money to really make you sell again I am not trying to be a real estate attorney, this is simply the way i see it after all the bad acts on real estate consumers I have seen.
You were Mislead.
They can huff and puff but what really can they do, look up your state laws, know your rights, Realtors don't know the law nor are they trained in what consumers need them to be...

First try to explain your situation to the seller and Realtor if nothing works out.I would suggest you to seek an attorney help in this situation. He would be in a better position to help you.
