My husband and I signed a lease for a home in california for a year . In january of 20o8 i was on dissability due to maternity leave. That same month my husband was laid off of work. After 6 months of living there we couldnt affrod to stay and had to move in with a family member due to our financial situtation. We spoke to the property management and asked if they could break the lease due to our situation and they refused. Being a good citizen and trying to avoid eviction, we paid our last months and gave our 30 days notice. They keeped our 1400 deposit and now they are charging over 4000 dollars for from what i assume is the last couple of months of rent left over on the lease. they didnt even provided an itemized receipt of how they came up with that amount and they automatically sent us to collections when i even took the time to give them the new address. what can i do? can i sue them in small claims for any of this? they also failed to fix our a/c and change our carpet and floor since they promised they would.
