I live in California and only income is VA pension and SSI. A creditor levied my checking account recently and I filed a Claim of exemption with the sheriff along with a copy of my direct deposit amounts. They objected to this and I have to go to a court hearing.
My bank denied the levy on the basis of my direct deposits. Do I have to appear at this hearing or can the judge make a ruling on what information he has? Can I prepare a written statement without having to appear in court with proof of my income?
From what I've read, I did not need to file the claim of exemption, as it is automatic. Any help or advice? I really don't want to go to court unless absolutely necessary.
