Help!! I live in New York State I signed an 18 month rent with option to buy lease with 2 riders attatched. The one rider states that the landlord must perform certain repairs within 30 days of occupancy it has now been 4 months and many are still not done including fixing spindles on the upstairs landing which my 4 month old baby could possible crawl through and fall down 10 feet. Also, the same rider states that the landlord/seller has no knowledge and has not participated in dumping or storage of hazardous waste. He was ticketed last month for dumping used motor oil on the property and has a court case pending with the department of environmental conservation. I have tried to negotiate to break the lease but due to this instance he will not negotiate. I do no longer want to stay and have found a new place I do not want to endager my baby's health or well-being or safety for that matter. Do I have a case if they take me to court for the rest of the rent money. It has only been 4 months.
