I have a male friend who helped a female friend move from her apartment. She had been evicted from her apartment because she had pets when they were not allowed. She called him to help her move because she knew he had a trailer. He helped her move all day. They were supposed to have additional help, but of course, no one showed up. They loaded up the trailer and only had the girl's leather sectional sofa left. They got one piece in, but the last piece wasn't exactly fitting on the trailer nicely. My friend made the comment that it wasn't going to fit and that they needed to make two trips and just to come back and pick up the other piece of the sofa later. The girl said no, she didn't want to make two trips. After figuring out a way to get the section on the trailer, she went ahead in her car and he pulled the trailer following. My friend took a wrong turn somewhere and had to turn around. So he did a u-turn. When he did, the second part of the couch fell out of the trailer and drug on the ground. There was some damage to the sofa- scrapes on the backside and a silver dollar size hole at the bottom. When he got to her new apartment, he told her about what happened and offered to pay for the damage. She told him no, don't worry about it. Now, a month later, she is threatening to sue him for the entire price of the couch ($1000). Would she have a case against him or would the case be dropped since he was helping her out and was not being malicious or purposefully negligent?
