I injured my knee on the job in the middle of May '08. At first the doctor they sent me to said that I might have torn my MCL and I had to wear a knee stabilizer and do sit down jobs ONLY until I got an MRI. That was almost a month's wait to get it done and to get the results. While I was in the stabilizer they always found me work to do and I did my 10 hours a night 4 days a week. Well, the results were good. No tear but a SEVERE sprain and a ganglion cyst showed up on my knee and some arthritis, too. The doctor gave me restrictions of being able to do my job for 4 hours a night (I stand/walk on my job) the rest of the time (6 hours) I am to do seated jobs only. I went back to the doctor 3 weeks ago hoping to get off my restrictions but when I told her I was still in pain the more I was on my feet, she said she was sending me to a Orthopedic specialist because I shouldn't be in any pain and she may have missed something but had to wait for the approval to send me. So I am still on my 4 hour standing restrictions. Slowly within the last month my hours have dwindled down to only 4 hours a night with them saying there isn't anything for me to do. I have suggested another job (which they have a in house job posting for) which is mainly a seated position and I have been denied saying they were training someone else. I can't live on approximately 16-20 hours a week. Is there anything I can do legally??? Oh yeah, it isn't BWC. They go through a place called SIMCO (Self insured management company) and now things they have approved for the doctor to do (physical therapy) they are now denying payment. Someone please HELP!!!!
