Squatting in public land may be regularized wherever possible, but land required for public and social purposes must be protected and selective re-location of squatters from ecologically sensitive land must be undertaken. The state must intervene to provide equitable access to land to all sections of the people.
When the Urban Land Ceiling Act was proposed nearly three decades ago, the land use pattern in Kerala was mostly agrarian. The conditions in recent times have undergone a drastic change. Thus to bring increasing quantities of land to the market the Urban Land (Ceiling and Regulation) Act, 1976, should be drastically amended, and supplemented by taxation measures that would discourage landowners from keeping their land vacant and encourage its proper utilization.
Various forms of land use through land exchange scheme, layout approval and other similar measures need to be encouraged. Similarly the land acquisition Act should be amended to eliminate delay and ensure timely payment of compensation to the affected people whose land has been acquired to put up mega projects. Certain clauses in the Land Reforms Act and the Land Acquisition Act totally restrict the activities of builders who specialize in building Apartments in Cochin and in other parts of Kerala.
All laws, which inhibit or restrict the recycling of land, should be suitably modified to speed up land utilization. Many of the states in India have already implemented measures to amend the laws enacted in times past when the social conditions were totally different than that prevailing in recent times.
