View Full Version : Court citations/failure to register rental houses I SOLD!

I sold some houses I owned in Garland, Dallas County Texas owner financed and the documents I used were a.) Warranty deed with vendors lien, b.) Real Estate Lien Note and c.) Deed of Trust. These documents were based on ones from a title company I closed with when I bought some of the houses. One of my friends who is upper management there said I could use all of the language on the documents as long as it was on my forms, not photocopies of theirs, and if I replaced the trustee name the title company uses with my name as the trustee, which I was told was okay. I closed the buyers and did not use a title company. The buyers signed the real Estate Lien Note and the Deed of Trust. I signed the General Warranty Deed. I also provided the buyers with a Settlement Statement, amortization schedule, lead base paint addendum and protect your family from lead brochure since the houses were aged between 40-60 years old. None of the documents were signed in front of a Notary Public since we did not go to a title company however the title company told me as long as the documents we used were agreed to and signed by the buyers and the seller then it was a proper sale of property.

The City of Garland enacted a rental registration program schemed up by several crooked City Council members of which some are no longer in power. The ordinance was challenged in Court by a group of people against the ordinance however is still in force. I notified the city Code compliance department via USPS mail and certified mail that I no longer owned the houses I sold and told them they could contact the new owners at each address. When code would write or call me I had to tell them again that I had sold the houses and reminded them of the letters I had sent them. Some of the Code officials I spoke with told me they were aware I had sold or was selling the houses. I have been issued court citations for the houses for failure to register rental property and was given additional citations by the same code compliance officer that wrote the other citations when I went to court to enter my not guilty plea. I told him calmly once again, that I did not own and I was not renting out these houses and he became rude, belligerent, threatening and stormed off. Some of the citations he wrote me were for houses I sold for all cash, vacant houses that are being marketed for sale not rental and houses that I owner financed, not contracted for deed. Code is demanding me to register houses as rental property that I have already sold with owner financing or all cash and houses that are or will be for sale, not rent. I have contacted the City Council member in the district where the majority of these houses are located in to request the citations to be dismissed since the code officer and a court official will not listen to me however it’s now going on three weeks without a response. I have to return to court in eleven days to request a trial by Judge or a trial by jury according to the Judge. The Judge told me the court is a court of record and it is difficult to appeal out of this court. The City of Garland is located in Dallas County. If you have any suggestions or comments that will help me with this situation I would greatly appreciated your input. Thank you.
