I need some advice from someone familiar with NYS labor laws regarding commission compensation. When I was hired for my current job, I receive a base salary plus a monthly commission based on production. My commission is based on 5 different critias, which is explained in detail on paper. Because of dishonest co-workers in the same position as mine but in different locations. The company vice president sent an e-mail a few months ago, stating that because of daily deposits not being deposited in a timely fashion. Any office mgr responsible for a deposit not deposited the next business day, will not be paid commission for the entire month.
Unfortunately last week, I did not make a deposit the next day because it was in my glove box and was not deposited until 2 days later. The entire deposit was for $1600, inwhich $5 was cash and the rest in personal checks made out to my company. My regional mgr and operations ngr called me today to let me know that my commission will not paid. It would have been around $6500 which is double my base salary for the entire month.
I need to know if this is legal?
