I have rented this house in Texas for almost six years under the management of three property management agencies. The last is now the new owner. I have never signed a lease with this manager/owner and am on month-to-month. Nov of 2005, I had a rent check returned and was late for December. Since then I have been attempting to regroup, but am always behind because I am assessed 32 dollars daily for late fees. I make arrangements and attempts but usually something comes up and I cannot make the arrangement. He now has judgement for possession, but I have written a 30-day notice to vacate. In Dec. I sent $1800 and sent 1000 today and he expects another 1000 by Friday. I cannot afford this. I am a single mom of three children and a teacher with virtually NO support.
Can he evict me before the 30 days even though he has the writ for possession and I have submitted a notice of intent to vacate?
