Can someone tell me if my son's civil rights have been abused....
He was arrested and they placed a $50,000 cash bond was placed on him.He was held 71 days and when he went to court his Public Defender told the judge he was under a writ of Habeus Corpus or something like that and that they had held him for 71 days without officially filing charges on him.
The judge shut off the volume so they couldn't hear what was being said between him and someone else and the P.D. told him he would like to hear what was being said about his client.The judge asked my son how long he had been locked up and he said 60-70 days and the judge said well Mr **** today is your lucky day ...you're free to go...
Now my son tells me that he has to return to court the 17th of this month,because they are recharging him with this same charge...
PLEASE!!!!Can someone tell me if they can legally do this...???While he was in jail,he told the guards he was cold several times and the guards told him to sleep under his mat....my son said **** you and the guard said "Do you want some of me?"the guard then proceeded to open the cell and tell him to come on out and get him some...he grabbed my son by the head and rammed him into the wall and then another guard pepper sprayed him and drug him to a back room and they told him "Now you're back here where their are no cameras and you will obey what we tell you and proceeded to beat him and kicked him in the back three times.He has had back surgery and had major problems with his spine all his life(since he was 8).I called the jail and asked why they were treating him like that and i was told he wanted it and they gave it to him...Oh after they did this they put him in an isolated cell by himself and took away his visitor priviledges from his father who has throat cancer and may not have long to live...Wouldn't allow him any phone calls and we were told that after 30 days they would be able to destroy the tape that showed part of it and that was why they took awaay his right to communicate with anyone so he wouldn't be able to prove anything...
I called the head over the jailers and he called me a liar and said none of that ever happened...even though another guard told me it had and a friend of his had called his dad and told him what had happened thats how we knew...This took place in the state of Arkansas!!!Anyone with knowledge of Arkansas law Please help!!!I just need to know if they have the right to turn around and recharge him....
