View Full Version : Sharing maintenance expenses in a land partnership

Question for anyone out there who would like to answer. Myself and 4 other men are in a partnership together. We own 26 acres of hunting land with a modest hunting cabin on the property. Four of the 5 of us use the land for hunting as it was intended. The same four of us take time out of our schedules to drive anywhere from 2 1/2 to 4 hours a few times a summer to maintain it. We have to mow the property, spray for insects, set traps,etc. All of this costs money and time. The other "partner" never uses the land for anything and also does not contribute towards the maintenance. Our question is this....as we entered into this with a "gentleman's agreement" and we all split the property tax bill as well as the insurance bill annually, what ground do we have to request this other partner to kick in some cash towards maintenance. If he isn't going to pay w/ his time, we think he should open the wallet. Everytime we have to get money out of him, he complains that he shouldn't have to pay anything as he isn't using it, yet he gets to reap the benefit of this land gaining value and him owing a 1/5 of it. He complains but doesn't seem to want to sell out his share to the rest of us either....any suggestions or advice would be greatly appreciated!

Aside from moral obligation to share since your other partner reap benefit from you maintaining the land, he is also under some legal obligation to contribute to the expenses of maintaining the same such as payment of taxes, repairs, etc. Speak with an attorney (http://www.mesrianilaw.com/Business-Law.html)for concrete advise.
