Hi, my name is shari.

Hi, I worked for a bagel bakery for 6 1/2 yrs. The last 2 yrs as General Manager. In May of this year, I quit.

At the end of Feb. of this year, I was told I had Breast Cancer. My boss Paul stated "we'll work through this" When I started using my Paid time off, Paul's attitude changed. He made me feel like I was a inconvenience now that I needed to use my time off, and he needed to find Mgmt. coverage for my bakery in my absence.
In short, Paul has been hostile, degrading, belittling and unprofessional. On 2 occasions, Paul got so close to my face, he spit on me as he was screaming at me. (a team member was present on one occasion)

As I used my pto, due to breast surgery, I returned to work, and the attitude was very wierd. On the night of 5/5 at 5pm, one of my other bosses called me at home to summons me to a meeting the next morning at another bakery. With a HR rep. present, along with Paul, and another boss (Jeff) I was put on a 60 day performance notice (for policies and procedures they said were not followed in my absence). I feel this was their way of pushing me out.

Anyway, on Thurs. 5/8 Paul called me at home @ 7:30pm to discuss an incident that happened with a guest at my bakery on 5/5. I tried to explain what had happened, but as usual, Paul started to yell, and berate me over the phone.He was yelling, and I finally broke down.
I asked him what I ever did to him, to be treated this way? His response was "if the fire is too hot, then get out of the kitchen sweetie" I felt like I had no other choice, so, I quit. He clapped, and said he needs a letter. I hung up.
I am sorry this is so long, but I need to know if I have a case against this man. I feel I was pushed out due to my illness. Now, I have no health ins. (who could afford cobra)
I complained about this man to my supervisor at that time during this period (Dec- Feb.) and also to the hr rep. at that meeting on 5/6
Come to find out, my immediate supervisor during this time period also complained to hr, along with other employees, from other bakeries.

I would like to know if I have a case against this man. I feel he pushed me to quit.
I looked for employment in NC with no luck, I moved back to NY. I just got off the phone with the NC unemployment office to file a claim, and she said in her honest opinion, I probably won't get benefits. I have been out of work 7 months now, I feel that would not be the case, if not for him.
