I own a townhouse - the neighbors rent and smoke (they have kids, we have kids), and fill our basement with the smell of smoke regularly. We have spoken to them and the owner, but they refuse to do anything. I don't think the HOA wants to act, and the council don't have ordinances that cover this problem. That leaves me with the option of suing, but I'm wondering how much that kind of action takes, and how much I stand to lose financially if my action is unsuccessful?
