My daughter has been leasing an apartment for the Fall Semester along with 2 other young women. Drug usage, heavy drinking and partying for the other 2 tenants became a common problem. Our daughter spent the Fall semester studying in a Starbucks because of the interruptions within the apartment. During finals the situation became intolerable. 1. One weekend when she had gone out of town her locked was jimmied so that during a party guests could go in my daugher's apartment and use the bathroom. 2. My daugher wrote a check to the mother of one of the other tenants paying her potion of the utilities and the name was changed to reflect the daughter's name. 3. Another incident was a night when violent screaming in the living area, woke my daughter and frightened her. Because our daugher was a graduating senior (with honors) we advised her to pack and go to a hotel for the next week to make it through finals and graduation. She had subleased the apartment to another person for the Spring -- thinking she would use the apartment during Summer 2009 as she returned for her work on her Masters in Accounting. This type of condition makes it impossible for serious student to apply herself and feel comfortable in her own space. Tomorrow we will move our daughter's personal belongings and will be meeting with the apartment owner. They had told our daughter there was nothing they could do. I think I remember from our experience with leaseing property that the owner accepts a responsiblity for drug usage when he/she has been notified. Please advise what recourse we have to A. get her out of the lease legally B. recoup some of our financial loss from paying for the hotel and eating out.
