My wife and I briefly separated and she found a house to rent and moved in. the rent was $500 and she paid with a check from our joint account. She only stayed one month and moved out. According to both her and the landlord she never signed a lease and the power was not in her name. The problem is that the check bounced. When I found out I called the landlod to pay him for check. He said he would take the $500 but would not give me my check back because he said she owed $1700 and that the check was the only document he had for collecting the $1700. I have tried twice to pay him $500 and get my check back but he wont give it to me and I am not giving him $500 unless he gives my check back. He keeps thratening me that he is going to DA office with matter if i dont pay him $1700. I am not going to give him anything other than the $500 for check. The rest should be a civil matter. Is what he is trying to do wrong. He really pressured me hard to go borow $1700 and give it to him right away. I cant see paying $1700 for a $500 check. Isnt that extortion. i am sure he has no docments on rental except check because he told me. I just want to give him $500 and get my check back. What do I do? Can the law help me?
