I loaned a friend some money to pay off their mortgage in August 2006 and they were suppose to record my contract shortly there after, but they did not, but assurred me that they would shortly but I forgot to follow them and it was not recorded and in fact they took out another mortgage on the property without telling me in Dec 07 now in Dec 08 they informed me that they can't make any more payments to me and hung up.
What can I do to secure my money at this point? Can I record my lien on the property without an attorney? Should I have a Colorado attorney review my contract for completeness? Should I bring the borrowees into court for "specific performance" and modify the contact in court? What would be my best avenue to mitigate the potential loss?
