View Full Version : Can you go to small claims when the person has moved out of state?

About a year ago, my bleeding heart husband loaned someone at work a sizeable (for us) amount of money with the understanding it would be repaid as soon as they were able. Well, months went by and through the work grapevine, my husband learned that the co-worker was moving out of state. When he approached her about the loan, she was very apologetic and gave him a check. She did state that since they were moving he needed to give her a few days to make sure the money would be in that account. He did as she asked and we ended up receiving a letter from our bank stating the account has insufficient funds. He notified her and she stating the bank had messed up when transferring money. In the meantime, she moved. We let some time pass before reminding her of the lack of payment. She was not responding to my husband's calls or emails. She finally responded and agreed to pay us through PayPal. This did not happen. After a few months, I sent her an email stating I would be contacting an attorney if she did not contact us about the repayment. I let it go a week, and then sent an email to her husband. She finally contacted my husband and stated she did not realize PayPal did not go through- another excuse about someone else messing up. My husband worked it out to invoice her through PayPal with half of the money being due at a certain date and the rest about a month later. She did not make either payment. My husband sent a reminder- with no response. And, he has sent emails again- with no response yet. According to the Oklahoma Small Claims Court information, you can only bring a suit against someone in Oklahoma. But, the transaction that created this mess occurred in Oklahoma- and the parties have now moved. Can we still bring suit? How can we get our money back?
