I served a corporation that I bought a home from. They had damaged my new home during construction and I also had to hire contractors to come and finish the work they abandoned. I was disabled and out of a home at the time too.
They refused my certified mail for service, so I had the Clerk use the Sheriff. I served both the President and the manager of this corporation individually. Neither of them showed up to Court. I was awarded the Judgment after the judge talked with me for $7,500.00 plus fees.
Now only the manager has filed a motion to vacate the judgment based on a family emergency for him not showing up. I was wondering what about the president of the company not showing up? He could of show up and said something to the judge about a problem they were having?
Do I have the ability to close the door on these people right now? They really did me bad and cost me $8,900.00 out of pocket plus already paying them for the house. They even told the bank they were finished and got paid a month before the bank walk through. Do you have any advice for me? I know they can appeal. Do you have any points of authority for reference I could look up for this case? Thank you
