So here it is....I co-signed a car loan for my exboyfriends BMW in December 2007, we broke up in March 2008. Two weeks after we broke up he told me he was gay...and that he had known for awhile but was in denial. Anyways, I told him after we broke up Id like him to refinance the car loan to take my name off of it, at first he refused saying he has bad credit and he didnt want a high interest rate...so I suggested having his new boyfriend become a cosigner, he doesnt want to do that and it has now been over a year since we bought the car. He has the car full-time, he insures it, he drive it, he has it all the time. I never see it. His boyfriend just bought a new truck recently so I know he has the credit to cosign for my exboyfriend but they dont want to, its not that they cant...they wont. I feel like he is milking off my credit which he did the entire time we were together. He hasnt missed a payment, I will give him that but I just dont want any kind of attachment to him whatsoever!
I was told there is no way of getting out of this loan unless he refinances or gets a cosigner, but this must happen with couples more often then not...there has to be a loophole. I was told I could take him to court but do I have a case? Would a judge really rule in my favor?....any advice here would be greatly appreciated.
