I live in NE Ohio. In December I was rear-ended one night on my way home from work on a snowy/icy road. No one was cited. Her insurance co. Allstate refuses to pay for my damage. I have liability through progressive. My vehicle is a 1992 Buick her vehicle is a 2008 BMW S5 SUV. Will I will if i take her to small claims court. I just want my damage paid for and my vehicle fixed.
Police officers summary "Based on the officers observations and investigation, neither motorist was believed to have committed a traffic violation. The weather conditions were heavy snow and the roads were covoered with a glaze of very slick ice. The moderate damage to each vehicle was caused by low speed impact after uncontrollable sliding and very little to no traction on the roadway. As a result neither vehicle operator was cited for a traffic violation."
