When my husband and I separated almost two years ago now, I guess he borrowed money from his aunt and uncle... $1000 to be exact and I guess they set up an agreement, NOT IN WRITING, that he would either pay them back or they get our John Deer Lawn Mower... Well he has not paid them back and since then we have reconciled... Well, now his aunt has filed suit in Small Claims court demanding payment... However, we have told them multiple times to take the John Deer because we could NOT afford to pay them back and they have repeatedly refused the tractor and not only to us but to my husband's parents as well!! Is this a breach of contract and what does this mean for us in Court??
