on March 3rd of 2003 i fell while working at a large surface mining co.and was sent to occupational health which was affiliated with the mining co.After 4 months of telling me it was only a sprained/strained shoulder i begged my Dr. to do a Mri which showed a torn rotator cuff.I had an open surgery and was put back to work in 6 weeks although i still had pain.I was fired from the company 1 year later and filed a wrongful discharge lawsuit which was settled on the premise that i signed off the workers comp claim.I have been having trouble ever since and today my my family dr took an x-ray and to my horror my arm was broken about 3 in below the shoulder which the surgeon had totally missed.Do i have any recourse against occupational health or the surgeon for not finding this break which in now causing me tremendous problems with calcium build-up and a rotator cuff that is still torn.my family Dr is beside himself on how they missed this as the mri prolly did'nt show that far down but i feel i was mis-diagnosed...Any response would be appreciated...Rex in Ohio
