Employer overpaid....

Back in September of 2008 my former employer paid me, even though I was no longer employed by them. I had been gone for 3 months. Now they want the money back 5 months later and 8 months since my termination. What recourse do they and I have? I don't have the money to pay them.

Got my bg packet. It asks if they can contact my current employer and if "No", they ask when?

Its a catch-22, I dont want them contacting my current employer since they will treat me differently, but I also want to be a trooper and have nothing to hide. How do we resolve this? Im also not 100 against them contacting my employer at any time, I just want this done delicately.

Employer is ok to pay me as per the contract though without any project , what my worry is about a full time offer which can help me in current situation, though my employer is not ready to take a project with that client as its not giving him any good bill rate
