My ex-wife and I have been seperated for eight years since 2001. She left the household, didn't help pay for ANY child surrport to help raise my 12 yo daughter at the time, didn't help pay for ANY of the house payments or upkeep, taxes or ANY of the bills at the time. Now I filed for divorce in Dec. and she is wanting 20,000 dollars cash, 5,000 dollars in payments for the rest, all so she don't have to pay ANY the penalties and taxes on a withdraw from MY 401K before we go to mediation on Monday. Plus her laywer wants me to refinance the home to cash out equity instead of utilizing the retirement.
My laywer is telling me "do not beleive the court would compel you to take out another loan on the house to pay your ex wife due to the interest charge alone and that she is not entitled to cash but an equitable distribution of assets only".
My question would be is the ex-wife entitled to anything as she abandoned the family at the time, didn't help with the household whatsoever or help raise my 12 yo daughter.
My ex-wife is not working and don't plan on working, she said. Plus I was ordered by the court to pay her maintanance of 225.00 every month til the divorce is over and finalized. I don't think the Judge had his listening ears on that day.
Am I the one getting stung in this situation or is this the way it is for the nice guy. Does this seem correct to ANY one? Help me Please!!!
