I recently removed my daughter from a family daycare and only provided a week's notice to the provider. My main reason is because of breach of contract because in the providers contract it states that parents that are full-time still pay when the child is not attending because of vacation, etc. My child's father would usually keep her on Mondays (which we still paid for), but on Friday, February 2 her father asked the provider to keep her the following Monday because he had an appointment and she declined to provide service. I later found out she declined because she was taking a class. Would this be considered a breach of contract in small claims court and what are my options for defending myself?
