I was laid off about a month ago. I was a project manager for a small construction company.

Back in July of last year we had a project where we were to install landscaping. As it turns out the landscaper had an old plan and the new plan required approximately $60,000 of additional work. I made an agreement with the landscaper that I would cover the $60,000 extra on future work. He gave us a final waiver of lein for the project and we moved on.

The landscaper found out I was laid off and is now going after my ex-employer for the money. He submitted an invoice to my old company yesterday.

I have 2 questions:

1. Can my ex-employer sue me personally for the amount the landscaper is requesting?

2. My ex-employer is on vacation and will be returning mext week. I know he will be calling me to discuss this. Should I take his call?
