View Full Version : Driver Consuming...Do i need a lawyer??

I was at a party when a fight broke out. I had a wine cooler bottle in my hand and i was called to take some subjects home from the fight. I was holding the bottle and hadn't drank anything for about 30 mins. When i ran and jumped in the car, i had the bottle, keys and cell in my hand and an officer was passing. He ended up giving me a "driver consuming" ticket, but as i stated, I only drank at the party, time had elasped and I totally forgot I had it in the midst of all the chaos. I have a witness that is willing to assist me in court to state that I never drank behind the will and I would have never had the bottle in my hand (inside the car) if the fight hadnt broke out and I wouldnt have had to run to get inside my vehicle. I was given a breathalizer 2 separate times and blew all 0.00. since my witness is going to court with me, do you think it is serious enough to get a lawyer??

Comsuming an alcoholic beverage while operating a motor vehicle is not a "serious" citation for the most part/ Most ordinances consider this an Infraction not a misdemeanor. Handled much like a seatbelt ticket - pay a fine and you are done. Hiring an atorney will have the same results but you will end up paying more in the long run unfortunately as you are facing some solid evidence. You were operating a motor vehicle and you did have in your possession an open bottle of alcohol. While you might not have drank any of it while you were driving is irrelevant to most court systems. Your friend will more than likely not even be given the chance to say anything in court unless you take the ticket to trial which often times tends to piss the court system off and brings out maximum sentencing. I would imagine that you are looking at a $50 fine (estimate) and possibly court costs - so roughly $100 bucks. If you hire an attorney you can multiply that times 5 in fines and fees. This ticket will not give you points on your license so I would just pay the fine and be done with it. But that is just my opinion.

Canuck suggests that most people can apply for immigration themselves, The services of an immigration lawyer or immigration attorney is not worth the money for the time it saves you. An immigration attorney usually get a clerk to fill in the immigration papers for you. You can do it yourself, You do not need an immigration attorney for that, It is an interesting notion.
