The Title Transfer Company on the sale of my house withheld in escrow for 2 state liens. 9 days prior to the closing a state court order was issued removing these liens.
I discovered this a few months after the closing when I needed a copy of the original HUD documents which were misplaced due to moving.
The documents showed an addendum which explicitly states that these liens should have not been paid due to the court order recorded by the prothonotary 9 days prior to the closing. This document was not presented to us at the closing. I certainly would have questioned the witholding in escrow.
When I challenged the Title company they initially were in agreement but said that it's not the total amount because there were expenses. When I asked for an explanation I got an "I'll get back to you" Which never happened.
I finally got to speak to the agent and the response was they will not pay me back. I said that I would take this up with an attorney. The answer was "go ahead" and a hang up of the phone.
Please comment. Do I have a case to recover in court?
