Background: Invested some money to start a photo business with 4 partners. One of the partners made agreements and then backed out and sold of the equipment and basically stole our money. We've been trying to contact him but he is avoiding us and only speaks sparingly with us. I was able to speak with him because he trusts me. One of the other investors had taken him in initially to help him out and to have him help start the business with him...the one who left took his credit card and ran up his debt. The investor who took him in whom I am best friends with knows that sometimes I am able to talk to him. He wants to see if I can talk with him on the phone and tape the conversations to see if he admits to the wrongdoings that he has done...my best friend is also aware that the guy who fled was evicted by his landord for trying to sell drugs for minors plus he has been talking to others and making false claims about my best friends character. He wants me to see if he will talk about this so if and when he does go to court he has a tape that he can use to attest to this guys character. My best friend lives in FL a two party state ....I live in OK a 1 party state and the guy who fled lives in Ohio a 1 party state. what I found on the net is a person can record someone if both are in a 1 party state with at least one (in this case me) having knowledge of the recording.
Questions: If I make the tape, can I give this tape to my friend in the 2 party state so he can use it for legal action? Is this legal? He is not going to use it for blackmail just to use it to see what kind of info he is putting out and to see if he admits any wrongdoing to attest for the guy's character? Can we legally do this? If I can, what kind of questions can I ask the guy....directly or indirectly...or would this be baiting him to admit to a possible crime? What are the legalities of this? Thanks
