judgement question

I received a check from a loan company which I signed and deposited into my bank account. My name was the only one on the check and I was the only one that signed it. A judgement was brought against me for not repaying the loan due to being laid off. However, they also brought the judgement against my soon to be ex husband. Since his name was not on the check nor did he sign it, can they do this?
