I was shocked this morning when I got a certified letter for a special proceedings summons.
My husband's mother passed away 4 years ago and we have been living in her home since then. The mortgage is in her name(we don't have the credit to get our own mortgage for it), but we have paid all the bills for the past 4 years. We filed her income tax return for the year she died and we do not know of any debts she may have.
The letter says a special proceeding has been commenced against us and that are notified to appear? I don't know where. It also says it is in the administrator of the estate's best interest to sell the real property and personal property of the deceased and decendents to settle debts. They are petitioning the Court to allow sale of our home. What should I do?
I have called the attorney's number that was on the letter, but I haven't got a response yet. I am so worried about my family losing our home.
